NOTICE OF HEARING

(Section 127)

 

TAKE NOTICE that the Ontario Securities Commission (the "Commission") willhold a hearing pursuant to section 127 of the Securities Act, R.S.O. 1990, c. S.5, asamended (the "Act") at its offices on the 8th Floor, 20 Queen Street West, Toronto,Ontario, commencing on Friday, the 9th day of October, 1998 at 10:00 a.m. or soonthereafter as the hearing can be held;

TO CONSIDER:

(a) whether to extend the Temporary Order dated September 24, 1998 to continuethe Cease Trade Orders against the respondents Robert Thomislav Adzija,David Arthur Bending, Allan Joseph Dorsey, Richard Jules Fangeat, GeorgeEdward Holmes, Todd Michael Johnston, Michael Thomas Peter Kennelly, JohnDouglas Kirby, Frank Alan Latam, Randall Novak, and Robert Louis Rizzuto untilthe conclusion of the hearing in this matter;

(b) whether to extend the Temporary Order dated September 24, 1998 to providethat the exemptions contained in sections 35(1)21 and 35(2)10 do not apply tothe respondents Larry Allen Ayres, Marlene Berry, Douglas Cross, AllanEizenga, Guy Fangeat, Arthur Krick, Michael Hersey, Ernest Kiss, BrianLawrence, Luke John McGee, Ron Masschaele, John Newman, NormandRiopelle, and Michael Vaughan until the conclusion of the hearing in this matter;

(c) whether, pursuant to section 127(1) of the Act, it is in the public interest for theCommission to make an order:

(i) that the registration of the respondents Robert Thomislav Adzija, DavidArthur Bending, Allan Joseph Dorsey, Richard Jules Fangeat, GeorgeEdward Holmes, Todd Michael Johnston, Michael Thomas PeterKennelly, John Douglas Kirby, Frank Alan Latam, Randall Novak, andRobert Louis Rizzuto be terminated or suspended or restricted for suchperiod as the Commission may order or that terms and conditions beimposed on their registration;

(ii) that the exemptions contained in Ontario securities law do not apply to therespondents Larry Allen Ayres, Marlene Berry, Douglas Cross, AllanEizenga, Guy Fangeat, Michael Hersey, Ernest Kiss, Arthur Krick, BrianLawrence, Luke John McGee, Ron Masschaele, John Newman, NormandRiopelle, and Michael Vaughan permanently or for such time as theCommission may direct; and

(d) such other order as the Commission may deem appropriate.

BY REASON OF the allegations set out in the Statement of Allegations of Staffof the Enforcement Branch of the Commission and such additional allegations ascounsel may advise and the Commission may permit;

AND TAKE FURTHER NOTICE that any party to the proceeding may berepresented by counsel if that party attends or submits evidence at the hearing;

AND TAKE FURTHER NOTICE that upon failure of any party to attend at thetime and place aforesaid, the hearing may proceed in the absence of that party andsuch party is not entitled to any further notice of the proceeding.
