OSC Proceedings


The OSC has broad powers to enforce the Securities Act (Ontario) and the Commodity Futures Act. We investigate allegations of misconduct in the capital markets and can initiate proceedings against individuals or companies suspected of violating securities law.

The Commission conducts hearings on enforcement-related matters, regulatory matters such as takeover bids, and reviews of decisions made by OSC staff. The OSC also has the authority to prosecute alleged breaches of securities law against defendants in the Ontario courts. For news releases related to court proceedings, see Before the Courts.

The Investment Industry Regulatory Organization of Canada (IIROC) and the Mutual Fund Dealers Association of Canada (MFDA) both investigate possible regulatory misconduct and can take disciplinary action. For more information, seeĀ IIROC-Enforcement and MFDA-Enforcement.

The power to prosecute alleged violations of the Criminal Code of Canada lies with the criminal justice system, typically through prosecutions by the provincial or federal Attorneys General.
